Difference Between RERA and HIRA

How is RERA different from West Bengal’s HIRA?

Although the fundamental concept guiding the well-organized growth and functioning of the real estate industry is the same in both situations, West Bengal HIRA differs from RERA in a few key ways.

These are the salient distinctions between the two:

  1. The Planning Area’s Conditions

RERA Act designates planning areas which can be any location assigned by the government or any other organization. These areas cover larger regions, including city extensions, and are not limited to the municipal domain. A specific time frame is preserved for projects that come under these planning areas.

However, the HIRA Act does not uphold this requirement of monitoring only planned areas.

2. Events

While the HIRA Act includes any other necessary position, the RERA Act only applies to natural disasters that hinder the development of projects, such as fire, flood, drought, conflict, earthquake, or cyclone.

3. Garage Space

A garage, as per RERA guidelines, is a covered space with three walls and a roof for parking any vehicle. It excludes open or uncovered parking lots.

There is no definition of the garage area in the HIRA Act.

4. Compounding of Offences

The 1973 Code of Criminal Procedure may be used to punish a defaulter for violating the RERA Act.

Notably, the HIRA Act does not mention any provisions on the compounding of crimes.
