MahaRERA, or the Maharashtra Real Estate Regulatory Authority, is the state’s central organization for regulating, developing, and registering real estate developments. In March 2017, the Maharashtra government established the MahaRERA authority following the implementation of the Real Estate (Regulation and Development) Act 2016.

1. Introducing the Maharashtra Real Estate Regulatory Authority or MAHARERA

MahaRERA, or Rera Maharashtra, was created to serve as a watchdog for Maharashtra’s real estate market. Maharashtra was the first state to fully execute the historic Real Estate (Regulation and Development) Act of 2016.

The MahaRERA aids in regulating, developing, and resolving homebuyer complaints in Maharashtra. MahaRERA encourages openness, accountability, and fair practices in Maharashtra’s real estate business. The MahaRERA, or Rera Maharashtra, is also in charge of registering new real estate projects, registering real estate brokers, allocating a valid RERA ID, validating legal projects, and speedy dispute remedies. 2. MahaRERA: Registration of Real Estate Projects

MahaRERA, also known as Rera Maharashtra, is the main body in Maharashtra for the registration of residential and commercial projects of 500 square meters or more. In the following stages, real estate developers can apply for new project registration with Maharashtra RERA. (Registration with MahaRERA)-

Step 1: Login (MaharERA login) to the MahaRERA official website, https://maharera.mahaonline.gov.in/.

Step 2: On the home page, pick the ‘Online Application’ link.

Next, Step 3: After selecting the ‘Online Application’ link, you will be led to https://maharerait.mahaonline.gov.in/.

Step 4: Select ‘new registration’ and complete the following form.

Step 5: Create a new user by filling in the data such as User Type, State, Username, Password, Mobile Number, and Email ID. Click ‘Go to login’ (MahaRERA login) after creating a new user.

3. What Documents do a real estate promoter need to register with MahaRERA?

To register a project with MahaRERA, the following documents are necessary.

  • Promoter/Group of Promoters PAN Card
  • Details about the property’s encumbrances/mortgages (if any)
  • Legal title copy
  • CA Validation Certificates (Form 3)
  • CA Validation Certificates (Form 5)
  • Valid Engineer Certificates (Form 2 – required only for ongoing/incomplete projects).
  • Certificates of Completion for Projects
  • Building plan copy and layout plan approval
  • The sale agreement and allocation letter are signed
  • Declaration on Form B
  • Valid architect’s certificate (Form 1 – required only for ongoing/incomplete projects).

4. Register  MahaRERA as a real estate agent

Follow the procedures below to become a registered real estate agent with MahaRERA or Rera Maharashtra.

Step 1: Login (MaharERA login) to the MahaRERA official website, https://maharera.mahaonline.gov.in/.

Step 2: On the home page, click the ‘Online Application’ link.

Next, Step 3: After selecting the ‘Online Application’ link, you will be led to https://maharerait.mahaonline.gov.in/.

Step 4: Select ‘New registration’ and complete the following form. Select the real estate agent user type.

Step 5: Fill in the data such as User Type (Select real estate agent), state, Username, Password, Mobile number, and Email ID, and then click Create New User.

5. What Documents are needed for MahaRERA registration as a real estate agent?

The following paperwork must be submitted to register with MahaRERA as an authorized real estate agent.

  • PAN Card of the relevant individual
  • Registration information, including the bylaws
  • Association Memorandum (MoA)
  • The Association’s Articles (AoA)
  • All letterhead copies must be self-attested.
  • a self-certified duplicate of the rubber stamp on the letterhead.
  • Receipts for valid acknowledgments that the agent may utilize
  • Income Tax (IT) declaration over the previous three years
  • Information on any active civil or criminal cases

6. Responsibilities of MAHARERA

  • For the quick resolution of disputes and grievances about registered real estate projects in Maharashtra, MahaRERA has also developed an adjudicating process.
  • to confirm and validate the real estate promoters’ declarations about their projects.
  • Enable the registration of new real estate projects.
  • Permit Maharashtra real estate agents to register

7. Which projects are exempt from the MahaRERA or RERA Maharashtra registration requirements?

  • The proposed real estate project will not take up more than 500 square meters of land.
  • The project will not have more than eight flats in total (all phases)
  • Before the MahaRERA Act went into effect, the promoter of the real estate project in question obtained a completion certificate (CC).
  • When marketing, advertising, or the new allocation of a residential flat, plot, or building is not included in a real estate project that involves renovation, repair, or redevelopment.
