1) What is HMDA?

HMDA refers to Hyderabad Metropolitan Development Authority. The largest urban development authority in India is HMDA.

i) Formation: It is formed by an Act (G.O.Ms.No.570 MA & UD (11) Dept in the year 2008 to manage all development of the Hyderabad Metropolitan Region (HMR). All responsible are taken HMDA like Planning, Coordinating, Supervising, Promoting, and Securing.

ii) Jurisdiction: HMDA covers an area of 7,257 sq km, 7 districts, 70 Mandals, and 1035 villages including GHMC Consisting of 175 villages and 40 Municipalities / Nagar Panchayats consisting of 138 villages and left 719 villages are comes under HMDA.

2) Roles and Responsible of HMDA

Here are Some Major roles and Responsible of HMDA:

  • Preparation of regional plans for the development of the HMR.
  • Approval of layout plans and building permissions for residential, commercial, and industrial projects.
  • Development of infrastructure such as roads, drainage, water supply, and sewerage.

3) HMDA Approvals

Coming to the approvals, what type of approvals are given to HMDA we will see below

Layout Approval:

The HMDA is responsible for approving the layout plans of residential, commercial, and industrial projects. The layout plan specifies the details of the proposed construction, such as the location of the buildings, roads, parks, and other amenities.

The approval process involves the submission of the layout plan to the HMDA, which checks the compliance of the plan with the relevant regulations and guidelines. Once the plan is approved, the developer can proceed with the construction.

Building Permission:

The HMDA is responsible for granting building permission to developers for the construction of new buildings or modification of existing buildings. The building permission process involves the submission of the building plan along with the required documents to the HMDA for approval.

The HMDA checks the compliance of the building plan with the relevant regulations and guidelines, including the Building Rules and Regulations, Fire Safety Regulations, and Environmental Clearance Guidelines, among others. Once the building plan is approved, the developer can proceed with the construction.

Occupancy Certificate:

The HMDA is responsible for issuing an Occupancy Certificate (OC) to the developer once the construction is complete. The OC certifies that the building is constructed as per the approved plan and is safe for occupation.

The process of obtaining the OC involves the submission of the building completion certificate and other required documents to the HMDA. The HMDA carries out an inspection of the building to ensure that it complies with the relevant regulations and guidelines before issuing the OC.

No Objection Certificate:

The HMDA also issues No Objection Certificates (NOCs) for various purposes, including the transfer of ownership of properties, change of land use, and mortgage of properties, among others. The process of obtaining a NOC involves the submission of the required documents to the HMDA for approval.

If you want to construct a building Under HMDA Limits then you must follow these HMDA building rules:

  • You must take Building plan approval permission from HMDA.
  • Follow the rules of Building height, didn’t construct more than 60 feet height, and must have a maximum of 15 meters of road.
  • follow Setback rules, like the distance between the boundary of the plot and the building. The setback rules are different for residential, commercial, and industrial buildings.
  • Parking requirements, For example, residential buildings must provide a minimum of one car parking space for every 100 square meters of built-up area.
  • follow fire safety regulations, such as the installation of fire extinguishers, fire alarms, and fire sprinklers in buildings.
  • Green building regulations, and construction of green buildings by offering incentives to builders who follow environmentally friendly practices.
  • After the construction of the building is complete, the builder must obtain a building completion certificate from the HMDA.

6) What is HMDA Mortgage System & How do Get HMDA Approval?

First, the developer submits the application form, land documents, land survey layout copy, income rates certificate, and conversion letter for HMDA Approve in the office. Checking all documents they release DC (development charges) letter to the total layout.

After paying the fee they issued HMDA Approved Copy with the LP Number. After full fill these conditions again, HMDA released the final approved copy for layout.

What are the conditions venture owners fulfilling?

How much fee is paid for this layout, when will we pay that fee, and what are the conditions fulfilled all are mentioned in the DC Letter. Under Development Charges, we must pay 80 Rs/- Per Sq. meter, Processing Charges of 10 Rs/- per sq. meter, Audit inspection charges, and Road impact fees all these charges pay to the HMDA within 30 days after the release DC Letter. If didn’t pay that fee on time they charged 10% Extra.

Mortgage:

HMDA Mortgage 15% plots with the numbers from Total Layout. Mortgage only from plotting area, not total area.

Land Conversion:

If didn’t convert from agriculture to non-agriculture we can pay an extra 5% land mortgage to HMDA.

After all these HMDA gives Final Approved Letter with the LP Number. In this approved letter HMDA mentioned a lot of conditions:

If we imagine the total area is 100% 

  • 7.5% of land for open space, (Park developments),
  • 2.5% of land for social infrastructure,
  • Nearly 30% of the land is for Roads,
  • 1.5% of land for Utilities.

we can live a total of 40% land for those developments. We constructed only 60% land and also sell plots and charge 60% of the land. The Developer didn’t sell 15% mortgage plots till come for HMDA Approval.
